When a company starts its operation in any countries, that date is considered as its business commencement date. It is usually the date on which your company undergoes business-related activities. For instance, the day you begin any activity for your company like purchasing pieces of equipment, setting up a website or even offering consultation to clients, is when your business commences.
Filing of Notification of commencement of Business
Every newly incorporated Hong Kong company has to notify the Inland Revenue Department with their business particulars for the commencement of business within one month of the commencement date. Information needs to be provided includes the nature of business, description, address, and the date of commencement. All this information has to be added in writing using Form IRBR200. Failure to submit the notification may lead to prosecution. The maximum penalty is $5,000 HKD and imprisonment for one year.
This helps the IRD in keeping proper records of the business activities for each Hong Kong company. Also, the company Business Registration Certificate will show the “nature of business” which has been declared.
